CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

  1. By placing an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the products they purchase.

  3. Shipping costs, including product delivery charges, will be paid by the buyers.

  4. Each purchased product will be delivered to the person and/or institution at the address provided by the buyer within the statutory 30-day period. If the product is not delivered within this period, the buyer may terminate the contract.

  5. The purchased product must be delivered in a complete and undamaged condition, in accordance with the order specifications, along with any relevant warranty certificates, user manuals, or other necessary documents.

  6. If the purchased product becomes impossible to sell, the seller must notify the buyer in writing within 3 days of learning about this situation, and the total price must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID:

  1. If the buyer does not pay for the product or cancels the payment in the bank records, the seller’s obligation to deliver the product will be nullified.

TRANSACTIONS MADE WITH THE UNAUTHORIZED USE OF THE CREDIT CARD:

  1. If, after the product is delivered, it is determined that the credit card used for payment was wrongfully used by unauthorized persons, and the amount for the product is not paid to the seller by the bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs covered by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

  1. If the seller faces force majeure events that cannot be foreseen and the product cannot be delivered on time, the buyer will be notified. The buyer may request the cancellation of the order, replacement of the product with a similar one, or delay the delivery until the issue is resolved. If the buyer cancels the order, the buyer will be refunded the amount paid within 14 days if paid in cash. If paid by credit card, the product price will be refunded to the bank within 14 days, but the transfer to the buyer's account may take 2-3 weeks.

BUYER’S OBLIGATION TO CHECK THE PRODUCT:

  1. Before accepting the delivery of the product, the buyer must inspect it for damages such as dents, breaks, or torn packaging. Damaged or faulty products should not be accepted from the courier company. Once accepted, the product is considered undamaged. After delivery, the buyer must handle the product carefully. If the right of withdrawal is to be used, the product should not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The buyer may exercise the right of withdrawal from the contract without any legal or criminal responsibility and without providing any reason within 14 days from the delivery date of the product to the buyer or the person/institution specified by the buyer, by notifying the seller through the communication information below.

WITHDRAWAL PERIOD:

  1. If the purchased product is a service, the 14-day period starts from the date the contract is signed. In service contracts where the consumer's consent has been given and the service has started before the end of the withdrawal period, the right of withdrawal cannot be exercised.

  2. The cost of using the right of withdrawal is borne by the seller.

  3. To exercise the right of withdrawal, the buyer must notify the seller in writing by registered mail, fax, or email within the 14-day period, and the product must be unused according to the terms outlined in the "Products for Which the Right of Withdrawal Cannot Be Used" section of this agreement.

USAGE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to the buyer or a third party, (If the product to be returned was purchased by a company, the return invoice issued by the company must be included. If the return invoice is not issued, the order returns cannot be completed.)

  2. The product should be returned along with its box, packaging, and any standard accessories, and must be undamaged and complete.

RETURN CONDITIONS:

  1. The seller is required to return the full amount and any documents that obligate the buyer within 10 days from the notification of the right of withdrawal and to receive the product back within 20 days.

  2. If the product's value decreases due to the buyer’s fault or if it becomes impossible to return, the buyer is liable to compensate the seller for the damage according to their fault. However, the buyer is not responsible for changes or deterioration in the product due to normal use during the withdrawal period.

  3. If the seller’s campaign threshold amount is reduced due to the use of the right of withdrawal, the discount applied under the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. Products prepared according to the buyer's request or clearly personal needs, which are unsuitable for return, such as lingerie, swimsuit bottoms, makeup products, disposable items, products with an expiration date or that may spoil quickly, products whose packaging has been opened by the buyer after delivery, and other products that cannot be separated from the product after mixing are excluded from the right of withdrawal.

  2. Cosmetic and personal care products, underwear, swimwear, books, copyable software and programs, DVDs, VCDs, CDs, cassettes, and office supplies (toner, cartridges, ribbons, etc.) must be unopened, unused, and undamaged for a return.

DEFAULT AND LEGAL CONSEQUENCES:

  1. If the buyer falls into default for payments made by credit card, the buyer agrees to pay interest according to the credit card agreement with the bank and be responsible to the bank. The bank may initiate legal proceedings, charge the buyer for any costs and attorney's fees, and the buyer agrees to compensate the seller for any damage caused by the delay.
